Multiple Arrests of Two Dozen Federally Charged in Valley Operation Targeting Hispanic Gangs and Associates in Connection with Narcotics Distribution

Two dozen individuals associated with the Mexican Mafia and other Hispanic street gangs were charged federally for their roles in a narcotics distribution ring operating in the San Fernando Valley, announced Salvador Hernandez, Assistant Director in Charge of the FBI in Los Angeles, and Michael Moore, Deputy Chief of LAPD’s Valley Operations Bureau.

An investigation was initiated early last year by the LAPD and the FBI’s Safe Streets Task Force to address gang-related crime in the San Fernando Valley. The investigation focused on identifying and disrupting drug trafficking organizations and related violence carried out by Hispanic gangs associated with the Mexican Mafia.

According to criminal complaints filed in U.S. District Court in Los Angeles, court-authorized wire interceptions, surveillance, and confidential sources were used during the investigation to purchase narcotics and weapons from the subjects in this case. The defendants are charged with conspiracy to distribute narcotics, Title 21, USC, Section 846. One subject, Oscar Carbajal, is charged with being in the United States illegally following deportation.

The criminal complaint outlines a narcotics distribution ring in which defendants played multiple roles in a coordinated methamphetamine trafficking enterprise, including sales, distribution and transportation.

Agents from several federal agencies and officers with the LAPD executed over a dozen federal arrest warrants and twelve federal search warrants that resulted in the seizure of cash, narcotics, and weapons. Several individuals charged in the complaint were already in custody and approximately four individuals were arrested on related and unrelated state charges.

Those arrested today will have an initial appearance in U.S. District Court this afternoon in downtown Los Angeles.

This investigation was conducted by the LAPD and the FBI’s Safe Streets Task Force, one of dozens of such task forces throughout the United States, funded for the purpose of assisting local police in identifying and addressing violent crime in America. Considerable assistance was provided during this investigation and in today’s operation by several additional agencies, including, DEA, ICE, ATF, Bureau of Prisons, the California Department of Corrections, and the Department of Child and Family Services of Los Angeles County. The defendants listed above will be prosecuted by the United States Attorney’s Office in Los Angeles.

When it comes to freedom on the Internet, Brazil is a free country according to a special report released by the Freedom House. The country has scored a total of 26 points out of a possible 100 [1] (the lower the score the greater the freedom), showing that it has a generally open environment with few government obstacles to access (5 points out of 25), a low level of content control (8 points out of 35 for limits on content), and few violations of individual users’ rights (13 points out of 40).

The main problem in Brazil, and according to the findings a growing threat, is judicial decisions leading to content censorship. Along with the United Kingdom and Turkey, the country faces a high number of violations of user rights from the threat of prosecution for libel and defamation. According to the report Freedom on the Net: A Global Assessment of Internet and Digital Media [2]: “Internet freedom is increasingly undermined by legal harassment, opaque filtering procedures, and expanding surveillance.” The same report offers the following statistical view of digital Brazil:

Freedom on the Net: A Global Assessment of Internet and Digital Media [2] investigated 15 countries with the aim of looking at emerging tactics adopted by governments to control internet and mobile phone use, including attempts to control, regulate, and censor the content of blogs, websites, and text messages.

A growing threat

Although freedom of expression is a constitutional right, there have been a great deal of civil and administrative charges against bloggers, notably lawsuits by politicians. The latest blogger to fall victim to one of these is Juvêncio de Arruda, from the very popular Quinta Emenda [3] [pt] blog, who has had to delete a few posts [4] [pt] at request of a former Para state parliament representative, Luiz Afonso Sefer, who is being investigated by a Parliamentary Inquiry Commission into pedophilia.

According to Judge Teresinha Nunes Moura’s decision [5] [pt], the blogger must refrain from publicizing either on his blog or any other media any phrase which might be linked to the concerned politician. If Arruda had not complied, he would have had to pay a daily fine of R$1,000 (about US$ 457.89). Fellow bloggers claim blogs have in fact had an important role in bringing to light the accusations that led to a state wise investigation into pedophilia, and see this as the latest display of censorship in Brazil.

Hiroshi Bogéa [6] [pt] points out that the blogger had commented on public information, and had been reporting on the investigation on a daily basis. He says that this suit shows that authorities are not happy with people having freedom of information:

Franssinete Florenzano [7] [pt], who has been following the investigation closely, cannot believe how quickly the blogger was judged, considering that Brazilian justice is infamous for its slowness to act. The suit was filed on the eve of a bank holiday and the summons was ready on the next business day. She points out that the justice system was very quick to punish the blogger who has made information public whereas the accused man in the investigation is free:

Lafayette [8] wishes that Brazilian justice was always fast like this:

I pray every day, holiday or not, for justice to work well like this for everyone, for the poor and for the rich!
Following the same line of though, the blogger at Blog do CJK [9] [pt] says he would not be surprised if the investigation into pedophilia comes to nothing:

Não se duvide, ao final de todo este processo, o único condenado pela Justiça pode ser o blogueiro.

Don’t you be surprised if at the end of the investigation the blogger is the only one to be condemned by justice.
José Carlos Lima [10] [pt] highlights the important role bloggers have played in the State of Para:

Muita coisa que hoje virou notícia no Pará, incluindo a CPI da Pedofilia, rodou primeiro no mundo dos blogueiros, cujo símbolo de todos nós é o Quinta e seu condutor Juvêncio Arruda. Nosso desagravo e solidariedade.

Alan Souza [11] [pt] confirms this type of silencing bloggers is a growing trend:

A moda infelizmente se alastra. O objetivo dos políticos é impedir que todos conheçam seus malfeitos. Por isso tentam censurar a livre opinião dos blogueiros…

The trend unfortunately has spread. These politicians’ goal is to prevent people knowing of their misdeeds. That’s why they try to censor bloggers’ freedom of expression…
A growing trend

News of blogs being closed down, bloggers having to delete posts or receiving threats abound, appearing on a near monthly basis. In October last year, a policeman’s blog and great source of police news, Flit Paralisante, was ordered to be deleted [12] for no clear reason. According to Rodrigo Viana [13], it is believed that São Paulo’s Governor José Serra had something to do with the decision:

Mas, qual a justificativa para tirar o “blog” do ar?
Cometeu crime? É proibido delegado escrever na internet?

O mais estranho é que na sexta-feira ainda, poucas horas depois do despacho do juiz, gente da Secretaria de Segurança Pública de São Paulo ligou para as redações “avisando”: olha o blog do delegado saiu do ar.

Por que tanta diligência, tanta pressa em dar a notícia? Esse é papel de Secretaria de Segurança?
A decisão do juiz foi dada sob encomenda para o governo Serra? Por isso, a secretaria estava comemorando?

But what was the justification for taking the “blog” down?
Did he commit a crime? Is it forbidden for a Chief of Police to write on the Internet?

The most strange thing is that even on Friday, just hours after the the court order, people of the Cabinet of Public Security of São Paulo called the news outlets “informing” them: look, the Chief of Police’s blog has been taken down.

Why do they care so much, hurrying to break the news? Is this the role of the Security Cabinet?
Was the judge’s decision an order from the Serra government? And therefore the Cabinet was celebrating?

Chief of Police Roberto Conde Guerra did not give up and started updating a new blog hosted on another platform [14] [pt], which is an easy way to trick the prosecution system. However, in most cases the affected bloggers have no financial resources to pay for the court fees and decide just to stop blogging. Meme de Carbono [15] [pt] analyses the case of some bloggers who paid the price for complaining online about services they had paid for and were not happy with: apparently, according to Brazilian laws, customers who complain online even if based on actual facts, and name and shame, can be sued for pain and suffering, slander and defamation. He says this only contributes to impunity:

A justiça está sendo usada como um manto de invisibilidade que protege maus profissionais assim como o Um Anel de Tolkien protegia e corrompia quem o usasse: a invisibilidade corrompe mais do que o poder.

Todo ser humano deve ter direito de reclamar quando se sentir mal atendido, deve ter o direito de alertar os outros (e não só os amigos) de riscos que eles correm. (…)

A mídia tradicional tem recursos e advogados para defender seus direitos, mas os cidadãos ficam acuados sem possibilidade de defesa caso não disponham de recursos o que, infelizmente, é comum. O caso do post reproduzido a seguir é justamente esse: a blogueira perdeu pois não podia pagar os custos para recorrer contra a decisão em primeira instância.

The justice system is being used as a cloak of invisibility that protects bad practitioners the same way that Tolkien’s ring protected and corrupted whoever wore it: the invisibility corrupts more than the power.

Every human being should be entitled to complain when they feel poorly served, they should have the right to warn others (and not just their friends) of the risks they run. (…)

The traditional media has resources and lawyers to defend their rights, but citizens are cornered, unable to defend themselves if they have no resources, which, unfortunately, is common. The case of the post reproduced below is precisely this: the blogger lost because she could not pay the cost to appeal against the decision at first instance.

Alternatively, they may face court and prove they have not done anything wrong. In Rio Grande do Sul, A Nova Corja blog has had to delete parts of its posts [16] and now the bloggers behind it face their second suit in one year because of a post they wrote back in June 2008 [17]. The first time, they won the case [18] as the suit was rejected on the grounds of ineptitude. They are now expecting proceedings of the others, which are based on the same post:

As pessoas precisam aprender, de uma vez por todas, que entrar na Justiça não é forma de ganhar a vida. Hoje em dia, qualquer coisa é “dano moral, calúnia, difamação”. Parem com isso. Considerem trabalhar.

People need to learn once and for all that filing a suit is not a way to earn a living. Nowadays, everything is “pain and suffering, slander, defamation.” Stop it. Consider working.

Só havia um problema para José:
até hoje Maria não tinha liberado
nada mais que uns amassos. Um

José começou a tirar a blusinha de
Maria,abriu sua calça e quando achou que finalmente ia rolar, Maria cortou o barato falando:

Sem entender o que era 'tulipa roxa' José levantou-se e saiu. Foi à casa de Joana, uma loirinha que era um caso antigo dele, daquelas que liberava geral.
Ao chegar José não pensou duas vezes e foi logo para cima de Joana.
Rola prá cá, rola prá lá, depois de várias posições ele não pensou mais e disse:
- Joana, não acha que já estamos sem muitas ideias para nossas
transas?
- Também acho, Morzinho.
- Então, quem sabe você poderia fazer uma tulipa roxa?
Joana ficou branca e logo gritou:
- QUEM VOCÊ PENSA
QUE SOU? POSSO SER SUA AMANTE, FAZER TODO TIPO DE SACANAGEM, MAS VOCÊ ESTÁ
ACHANDO QUE SOU DESSAS QUE FAZEM TULIPA ROXA?!
A MOÇA ENFIOU A MÃO NA
CARA DO COITADO!
- FORA DAQUI, JÁ!! Jogou tudo o que tinha em cima de
José, que não teve alternativa a não ser sair correndo, com as calças na mão.
No dia seguinte José foi para o trabalho, mas não parava de pensar como deveria ser a tal 'TULIPA ROXA'.
Claro que não perguntou para nenhum amigo, pois não queria passar vergonha.
A solução seria uma visita ao
puteiro local (tipo Café Monique). Para lá se dirigiu, à noite.
Depois de beber umas e outras, sentiu-se preparado e chamou uma das 'garotas', linda, de parar o trânsito. Quando foi para o quarto foi logo perguntando:
- Você faz realmente tudo?
- Claro. Estou aqui pra isso, fofinho.
- Qualquer coisa,mesmo?
- Sendo franca: estou aqui para ganhar dinheiro e faço tudo o que for preciso, anal, oral, o que você quiser.
- Então vamos começar logo com a tulipa roxa?
Sem pensar, a putinha tascou um tremendo tapa na cara de José e foi gritando:
- SEU SEM VERGONHA. SOU PUTA, MAS NÃO SOU QUALQUER UMA. QUEM VOCÊ PENSA QUE EU SOU?!! A VAGABUNDA ENFIOU A MÃO NA
CARA DO COITADO, DE NOVO!
Enquanto fora do quarto todo o mundo escutava seus berros.
Sem entender o que estava acontecendo o 'segurança' (vamos ser honestos, o cafetão do local) invade o quarto, irritado, pergunta: - Senhor, o que está acontecendo aqui?
- Meu caro, eu só perguntei se ela fazia de tudo. - respondeu José.
- Ora, aqui todas fazem de tudo. Não estou entendendo. - disse o cafetão.
- Mas, quando eu pedi para ela fazer tulipa roxa ela enlouqueceu.....
Sem deixar José concluir a frase o cafetão saca o revólver e vai berrando:
-AQUI É UM PUTEIRO DE RESPEITO, MINHAS MENINAS NÃO
SÃO DESSE TIPO.
SAIA DAQUI, SEU FILHO-DA-PUTA, ORDINÁRIO, SENÃO TE FURO O
RABO!!! E José, novamente sem ter escolha, saiu correndo e foi para a casa de Maria.
Ao chegar, falou:
- Maria, case comigo, agora, por
favor.
Afinal, José não aguentava mais não saber o que era tulipa
roxa..
Dois dias depois casaram-se e foram para a lua de mel. José
esperançoso. Mas no caminho da lua de mel, sofreram um acidente.

Maria morreu.
Até hoje José chora.
Não de saudade, e sim de raiva, pois não conseguiu descobrir o que é tulipa roxa.
E a gente, também, vai ficar com raiva! Afinal, se José não descobriu o que é tulipa roxa, muito menos eu, que só recebi esta mensagem de um filho-da-puta que também não sabia, e perdi um tempão lendo essa porra deste e-mail e não descobri o que é essa merda de tulipa roxa!!!
Então pensei, Por que tenho que ser otário sozinho. Por que não dividir a frustração com vocês, que são meus amigos, não é?!?

Não adianta colocar somente na conta dos pobres!

Sylvio Guedes, editor-chefe do Jornal de Brasília, critica o 'cinismo'
dos jornalistas, artistas e intelectuais ao defenderem o fim do poder
paralelo dos chefes do tráfico de drogas.
Guedes desafia a todos que 'tanto se drogaram nas últimas décadas que
venham a público assumir: eu ajudei a destruir o Rio de Janeiro'.

É irônico que a classe artística e a categoria dos jornalistas
estejam agora na, por assim dizer, vanguarda da atual campanha contra a
violência enfrentada pelo Rio de Janeiro.

Essa postura é produto do absoluto cinismo de muitas das pessoas e
instituições que vemos participando de atos, fazendo declarações e
defendendo o fim do poder paralelo dos chefões do tráfico de drogas.

Quando a cocaína começou a se infiltrar de fato no Rio de Janeiro,
lá pelo fim da década de 70, entrou pela porta da frente.

Pela classe média, pelas festinhas de embalo da Zona Sul, pelas
danceterias, pelos barzinhos de Ipanema e Leblon.

Invadiu e se instalou nas redações de jornais e nas emissoras de TV,
sob o silêncio comprometedor de suas chefias e diretorias..

Quanto mais glamuroso o ambiente, quanto mais supostamente
intelectualizado o grupo, mais você podia encontrar gente cheirando
carreiras e carreiras do pó branco.

Em uma espúria relação de cumplicidade, imprensa e classe artística
(que tanto se orgulham de serem, ambas, formadoras de opinião) de fato
contribuíram enormemente para que o consumo das drogas, em especial da
cocaína, se disseminasse no seio da sociedade carioca - e brasileira -
por extensão. Achavam o máximo; era, como se costumava dizer, um
barato.

Festa sem cocaína era festa careta.

As pessoas curtiam a comodidade proporcionada pelos fornecedores:
entregavam a droga em casa, sem a necessidade de inconvenientes viagens
ao decaído mundo dos morros, vizinhos aos edifícios ricos do asfalto.

Nem é preciso detalhar como essa simples relação econômica de
mercado terminou.

Onde há demanda, deve haver a necessária oferta.

E assim, com tanta gente endinheirada disposta a cheirar ou injetar sua
dose diária de cocaína, os pés-de-chinelo das favelas viraram barões
das drogas.

Há farta literatura mostrando como as conexões dos meliantes
rastacuera, que só fumavam um baseado aqui e acolá, se tornaram
senhores de um império, tomaram de assalto a mais linda cidade do
país e agora cortam cabeças de quem ousa-lhes cruzar o caminho e as
exibem em bandejas, certos da impunidade.

Qualquer mentecapto sabe que não pode persistir um sistema jurídico
em que é proibida e reprimida a produção e venda da droga, porém
seu consumo é digamos assim, tolerado.

Que a mídia, os artistas e os intelectuais que tanto se drogaram nas
três últimas décadas venham a público assumir:

'Eu ajudei a destruir o Rio de Janeiro.'

Façam um adesivo e preguem no vidro de seus Audis, BMWs e Mercedes.'

E ainda acrescento: Ontem saiu nos jornais que o ator galã da GLOBO,
Fábio Assunção foi afastado da novela para "tratar de problemas de
saúde". Tais problemas todos sabem que são ligados à COCAÍNA, o
qual cheira, come com farinha e etc e tal há vários anos. Aliás,
todos sabem também que é na GLOBO, nas festinhas dos diretores de
núcleos, dos altos escalões da empresa que estão os maiores
consumidores. Muitos sabem e escondem que nessas festinhas se cheira na
bandeja. O que fazem? No final do ano, ou a cada caso mais chamativo
fazem PASSEATAS PELA PAZ NO RIO. São todos uns CANALHAS.
Quando o delegado HÉLIO LUZ (aquele que foi chefe de POLÍCIA no
governo da Benedita) disse que o brilho do pó começava em IPANEMA,
muitos dos GLOBAIS (INCLUINDO-SE AÍ os diretores de jornalismo da
emissora) fizeram campanha e logo o afastaram do cargo. Ele falava com
conhecimento de causa. Quanto tempo faz isso? Poucos lembram. Pois é,
essa canalhice não acaba nunca. O Rio de Janeiro por isso virou essa
cidade que vive uma guerra civil que ninguém tem coragem de assumir.
Conclusão: todos somos responsáveis também , por não divulgarmos o
assunto do conhecimento de muitos ...

I remember sitting in the LETN newsroom ten years ago, scanning the early reports of a terrible shooting in a high school in Colorado. It seemed to me like a Stephen King novel had come to life. What strange demonic forces were at work in the Denver suburb of Littleton? What on Earth was happening?
The news reports were ominous and getting worse every minute as the feeds came in from the reporters. Back then, LETN was a CNN affiliate so our staff was hunkered down, trying to gather facts from speculation, deciding whether on not to go “live” on air.
A year later, I went to Columbine High School (as did hundreds of other people from television stations from around the world) to report in person on the first anniversary of that tragic event. Unlike the other reporters, I was sitting with heroes from the Littleton SWAT team and going over their remarkable story and lessons learned from the paradigm-changing crisis they had endured. Needless to say, the other reporters were not happy when the Littleton Warriors refused to comment to them; they had come to tell their stories to their brothers and sisters in law enforcement.
Today, the story of Columbine has become the seminal event that started us all asking ourselves, "What should we do when there is no negotiation, no time for a Command Post, no time even for a full Tactical Deployment?" Immediately following the tragedy, the debate about the active shooter had begun in earnest and rightfully still does to this day. It is this debate that has sharpened the edge of the law enforcement response, improved the odds of patrol being able to terminate a threat quickly, and lead to a whole new generation of patrol-friendly tactical gear.
Thank this debate for elevating our awareness and preparation. If you have a “go bag,” a patrol carbine or rifle, and training in ad hoc team formation and response to active shooters, thank this debate. The horror of Columbine and all the other acts of violence and inhumanity that have followed (and will continue) should never leave our collective memories. The innocent are our precious concern and their safety and ours depends on our constantly seeking to be better trained, equipped, and prepared for the next time…and there will be next time.
I think of Jeff Chudwin, Al Baker, Ron McCarthy, Bob Weber, John Meyer, and myriad trainers and experts too many to mention in this short essay, who have given their hearts and souls to improving our ability to respond to these horrific events. I am reminded of the administrators who supported their men and women by demanding equipment and providing the training that swept our profession since that heartbreaking plot unfolding ten years ago.
We are not done yet though.
Columbine wasn’t the first, but it was a tipping point that created a firestorm of ideas, solutions, arguments, experiments, and changes. We know law enforcement must be a learning profession, constantly adapting and preparing for the next violent scenario to unfold.
I hope the one lesson you personally learned from the story of Columbine is YOU may hold the key to stopping the next horror. I don’t know what Officer Justin Garner of the Carthage, North Carolina Police Department was thinking when he rushed into a nursing home to stop a rampaging shooter, but I like to think he was responding with the training he had gotten based, in part, on the lessons learned from Columbine.

Não é á toa que entre os maiores desastres naturais causadores de mortes ao longo da história estão os terremotos, e em alguns casos os seus primos, os maremotos também conhecidos por alguns como tsunamis.



O ser humano parece que tem problemas com placas. Sejam elas placas de trânsito, placas bacterianas, plaquetas no sangue (que também não deixam de ser placas), ou neste caso as chamadas placas tectônicas, que são formações de rochas subterrâneas. Quando estas placas se movem, todo mundo literalmente dança ao ritmo catastrófico de seu deslocamento.



Na realidade o que choca é quando essas gigantescas rochas ocultas aos olhos se chocam, ou se afastam ou ainda quando resolvem fazer outro movimento qualquer, de forma inesperada e brusca, causando os tais abalos sísmicos, que literalmente abalam qualquer estrutura.



Grandes prédios caem como se fossem frágeis castelos de cartas de baralho, dessas que as cartomantes não usam. O mundo ao redor parece enlouquecer, ganhar vida, apenas para levar tantos a morte. Não há para onde correr, ou mesmo se esconder. O que antes era solo firme, vira um pandemônio que estremece a sanidade, levando qualquer um as ruínas da loucura.



Os abalos são similares a espasmos em um corpo doente. Um corpo que parece tentar alertar que também está de certa forma vivo e merece respeito, já que parasitamos sobre seu peito indefeso. Mas seu apelo justo torna-se injusto frente ao sofrimento causado há tantas almas inocentes, vitimas de seu estrondoso gesto fulminante. O tecido da realidade se rasga, dobrando-se aos caprichos dessas convulsões no seio da própria terra, que um dia nos espera para em seu ventre eternamente repousar.



Em momentos como este compreendemos que todas as nossas ações que por tanto tempo vêem prejudicando e destruindo este mundo, não são nada se comparadas ao simples ato de tremer deste mesmo mundo (em qualquer um de seus vastos recantos). Habitamos em um planeta, mas mal percebemos suas existência, e seguimos caminhando apressados, sem olhar na face onde pisamos, até ser tarde demais.
